Mark J. DePasquale
For over 25 years, Mark DePasquale has advocated for his clients in business disputes
and civil appeals.
He practices in federal and
state trial courts, and in Arizona's appellate courts. His clients range from
individuals and small businesses to Fortune 500 Companies.
Mark's practice focuses on:

Contract Disputes
Representing both plaintiffs and defendants in a wide variety of contract
disputes ranging from multi-million dollar, complex agreements involving
sales of commodities, derivatives and swap agreements, to disputes involving
sales of businesses, real estate and equipment (including breach of warranty
and misrepresentation claims), and disputes over simple oral agreements.

Advocating before the Arizona Court of Appeals and Arizona Supreme Court in a
wide range of matters, ranging from business disputes to
family law issues.

Representing parties in litigation involving claims of securities fraud,
under both state and federal law

Corporate Divorce Representing owners of closely held
entities in disputes including disputes over bylaws and operating
agreements, owner buyouts, wind-up provisions, allegations of breach of
fiduciary duty, and minority shareholder rights

Antitrust Counseling
Advising clients on antitrust issues focusing on distribution issues and
issues involving trade associations
Mark practiced for the first 10 years of his career with
O’Connor Cavanagh Anderson Westover Killingsworth & Beshears – then the second
largest law firm in Arizona – where he became a senior member. Since 1999, Mark has worked in a small or sole
practice, combining his
large-firm training and experience with the flexibility and lower overhead of a
small firm.
